Last Friday (6.30.2023), the Supreme Court struck down Biden’s administration plan to forgive up to $441 billion in federal student loan debt. The 6-3 ruling, which Chief Justice John Roberts wrote, found that the Biden administration did not have the authority to forgive student loans under the Higher Education Act of 1965. The court found that the act only gives the secretary of education the power to “waive” or “modify” specific law provisions, not to forgive student loans altogether. The decision is a major setback for President Biden, who had made student loan forgiveness a key campaign promise, and millions of borrowers with student loans.

What Does This Mean for Borrowers?

As someone with student loans, I had hoped to have some of my loans forgiven under the Biden administration’s plan. This could have been a significant financial reliever for me and many borrowers, especially those struggling to make ends meet. Once repayment starts, borrowers may be eligible for income-driven repayment or public service loan forgiveness. These programs can help people reduce or eliminate their monthly student loan payments.
Also, the Biden administration still has the power to pass legislation forgiving student loans or issuing new regulations allowing student loan forgiveness. However, it will be challenging to pass legislation in support of student loan forgiveness in the Senate and House of Representatives.

The Impact of Student Loan Debt

With all the political views regarding student loan forgiveness, the reality remains that student loan debt is a major financial burden for millions of Americans. The total student loan debt in the United States is over $1.7 trillion. This debt keeps many people from buying homes, starting businesses, and saving for retirement.

This issue needs to be addressed to improve the financial well-being of millions of people and boost the economy. Biden’s administration proposal to forgive a portion of student loan debt was one option that the U.S. Department of Education explored. In the coming months, I hope the department will develop new regulations to help alleviate student loan debt for the many people who need it. For now, borrowers await clarification on their student debt repayment plan.
